GENERAL TERMS AND CONDITIONS OF SALE

The "https://lancia-corsehf.com" website (hereinafter referred to as "the Website") offers a selection of products marketed by Stellantis Europe S.p.A. at its STELLANTIS MOTORSPORT RACING SHOP, hereinafter referred to as the STELLANTIS MOTORSPORT RACING SHOP, in particular technical parts and derived products which are COMPETITION parts exclusively intended to be fitted to motor racing vehicles.

Their assembly must be carried out according to the rules of the art and according to current practices.

COMPETITION parts sold to professionals do not benefit from any contractual warranty, insofar as their installation on a production vehicle only allows use in competition and not on the road network open to public traffic.

In addition, their use significantly modifying the characteristics of the vehicles (noise, pollution, maximum speed, tyre size, etc.) renders null and void the road approval issued by the appropriate services for the vehicle concerned, before the installation of the said parts.

The Lancia network (importers, dealers, authorised repairers, etc.) as well as the tuners are not agents of LANCIA CORSE, concerning the specific COMPETITION parts sold by LANCIA CORSE. If they intervene to assemble the parts sold by LANCIA CORSE, they act in their own name and are solely responsible to their customers for commitments of any kind made by them.

Access to the Site is open to all users, professionals or individuals (hereinafter referred to as the "Users").

The use of this Site is subject to the detailed Terms and Conditions described below.

It implies the full and unreserved acceptance by the User of all the provisions of these General Terms and Conditions of Sale which apply to all products offered for sale on the Site.

1. REGISTRATION PROCEDURES

The purchase of products online on the Site requires the prior registration of the User.

To order on the Site, the User has the option of creating a customer account called "General Public" by himself. To do this, the User must record certain data concerning him or her - surname, first name, address, telephone numbers, billing address, password - which are the subject of a declaration to the CNIL in accordance with the procedures detailed in the legal notice. The recording of this data allows the identification of Users and the verification of their status as consumers.

In order to benefit from special payment conditions or preferential rates, the User undertakes to complete a Lancia Corse account application form in a complete and good faith manner and to provide only useful and truthful information. After study, a Lancia Corse account will be opened online. The User will then be able to benefit from all the advantages granted to him when ordering online.

Stellantis Europe S.p.A. reserves the right, without notice, to terminate the registration and to permanently remove access to the site to any User who has provided incomplete or inaccurate information.

After filling in and validating the information requested, when placing the first order, the User receives an email to the email address he or she indicated during registration. It is understood that only one customer account can be created per email address.

2. MANAGEMENT OF PERSONAL DATA

Users have the right to access, modify, rectify and/or delete said personal data with the exception of the email address.

Special case of customers with a Lancia Corse Account: the modification of personal data will only be possible through LANCIA CORSE subject to validation by its legal representative.

For any request for modification, the User must make a written request that he will send by email or post to the address indicated in the "Contact" section

3. ONLINE PURCHASES

Users may purchase the various products for sale on the Site in the following ways:

Product:

Photographs, diagrams and texts describing the products are not part of the contractual field. LANCIA CORSE reserves the right to modify them at any time. LANCIA CORSE cannot be held liable for any differences between these elements and the products delivered.

Our product offers and prices are valid as long as they remain visible to us on the site, and within the limits of available stocks.

The availability of products indicated on the Site is provided for information purposes only and may be subject to change without notice.

In the event of a shortage of stock on one of the products ordered, Stellantis Europe S.p.A. will ship the products available from the order to the User as soon as possible and will cover the costs of shipping any remaining products or will contact the User if the product is at the end of its life.

Placing orders:

The user has the option of placing his order online.

The order can only be registered on the Site if the user has previously clearly identified himself by entering his username, which is strictly personal to him, and his password.

Any order implies acceptance of the prices and description of the products displayed at the time of the order as well as the general terms and conditions of sale.

Order Process:

Step 1: Identification

The User can consult the catalogue and fill his basket without being identified.

For security reasons, the User must identify himself as soon as the request for validation of the basket is made.

If the User is already registered on the "https://lancia-corsehfcom" website, he/she must enter his/her Username and password. Otherwise, they must register by clicking on "create your account" as detailed in the "Registration procedures" section of the general terms and conditions of sale.

Step 2: Choosing products

The user chooses a product that he wants to buy from the catalog and indicates the desired quantity in the shopping cart.

In the shopping cart, the customer sees a summary list of the products he has selected from the catalog.

They can then modify this list by adding or removing products.

Once the selection has been made, the User clicks on "Validate" to place an order.

The User can change their delivery and billing address in relation to the data entered during registration. (Except for customers with outstanding loans, see Personal Data Management)

Shipping costs are calculated based on the following criteria:

Place of delivery.

Weight and volume

Speed of transport.

Carrier rates.

In all cases, the final acceptance of the order, including shipping costs, by the User is subject to the acceptance of the General Terms and Conditions of Sale materialized by the validation of the box "I have read the General Terms and Conditions of Sale and I adhere to them without reservation".

Step 4: Payment method

The User selects the chosen payment method with which he wishes to pay for his order according to his profile:

-Bank card

- Outstanding credit

-Wire transfer

- Voucher

Combination of payment methods: It is permitted to combine the following payment methods:

- Voucher and credit card

- Voucher and outstanding credit (if the amount to be paid is less than the customer's outstanding amount)

It is not allowed to combine outstanding credit and credit card payment methods.

During this step, a summary of the order placed specifying the delivery costs and indicating the price including VAT of the order to be paid is available.

Step 5: Order confirmation

The User's order is validated after entering his bank details followed by a click on the "validate" box. After acceptance of the transaction by the bank, the User automatically receives an order confirmation email notifying the product(s) ordered and the delivery address.

Order validation and electronic signature

Any order signed by "click" constitutes an irrevocable acceptance which can only be called into question within the limits provided for in these General Terms and Conditions.

The "click" associated with the authentication and non-repudiation procedure and the protection of the integrity of the messages constitutes an electronic signature. This electronic signature has value between the parties in the same way as a handwritten signature.

Price:

The prices of our products are indicated in euros excluding taxes and all taxes included, excluding participation in processing and shipping costs (see order process).

VAT is payable at the applicable rate indicated on your invoice. The payment of French VAT is made according to the conditions set out in the table below:

In order to benefit from tax-free rates, foreign professional customers must follow a specific account creation procedure detailed in the "Create a professional account" tab.

Stellantis Europe S.p.A. reserves the right to modify its prices at any time but undertakes to apply the rates in force at the time of the User's order confirmation, subject to availability on that date.

Payment:

Online payment is allowed to private and professional Users.

Payment Terms.

Payment is made by credit card on the secure banking servers of LANCIA CORSE's partners (Stripe). This implies that no banking information concerning the User passes through the Site. Payment by credit card is therefore perfectly secure; The order is thus registered and validated as soon as the payment is accepted by the chosen bank.

LANCIA CORSE retains ownership of the goods, which are the subject of these debits, until they have been paid in full in accordance with Law No. 80-335 of 12 May 1980. In the event of total or partial non-payment on the due date for any reason whatsoever, by express agreement, LANCIA CORSE has the right, without formality, to physically take back the goods, at the expense, risk and peril of the customer(s) concerned.

Secure online payment

The User's credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never pass through the network in clear text (unencrypted). Payment is made directly to the bank. LANCIA CORSE has no access to these contact details, and does not store them on its servers. This is why they are requested from the User again for each new transaction on the Site.

Delivery:

The transport of your package:

Packages are usually shipped within 48 hours after receiving your payment.

Shipping costs include packaging, handling and freight costs. They are calculated from the weight, volume, destination and speed chosen.

We advise you to group your purchases into a single order. We cannot combine two separate orders and you will have to pay the shipping costs for each of them.

The products are delivered to the delivery address indicated by the User during the order process, except in the event of material impossibility (inaccessibility, exorbitant economic cost, force majeure, etc.).

LANCIA CORSE draws attention to the fact that it is the responsibility of the User, upon receipt of the delivery, to make precise and detailed reservations to the carrier, under the legal conditions, for any damage or shortcomings noted on arrival.

Complaints concerning missing parts or parts with apparent defects must be made on pain of foreclosure, within the deadlines specified in these general terms and conditions of sale for any type of order.

Unless otherwise agreed in writing between the parties, all goods shipped in France or abroad travel at the expense, risk and peril of the consignee.

The products referenced on the Site are in principle held in stock by the commercial store located at 2 rue Gay Lussac, 95500 GONESSE (France). However, due to circumstances that may affect production, some parts may not be immediately available. In this case, the order will be maintained at the initial conditions, unless requested in writing by the customer.

Claims concerning missing parts or parts with apparent defects must be made on pain of foreclosure:

• When they are picked up, refused accordingly, by the customer when he takes delivery of them in our stores.

• Within the day of receipt if they are sent by us to the customer's address.

Shipping time:

All the deadlines announced are average delays calculated in working days.

The time it takes to process, prepare and ship orders, for in-stock parts, may vary from 1 to 8 days depending on store availability.

To this period must be added the delivery time of the carrier, which varies according to the country and the speed chosen:

- In metropolitan France (excluding Corsica): 1-2 days.

- Outside metropolitan France: from 2 to 4 days unless there is a special geographical location.

Any transport hazards that would delay a delivery are not the responsibility of LANCIA CORSE but of the only carrier in charge of the delivery.

The packages are delivered either to the customer or to a carrier depot depending on the geographical location, the organization of the chosen carrier, the presence of the customer at the place of delivery, etc.

TRANSPORT:

All goods shipped in France or abroad travel at the expense, risk and peril of the recipient. It is therefore up to the latter to make precise and detailed reservations of use to the carrier, under the legal conditions, for damage or shortcomings observed on arrival.

Retention of title / transfer of risk:

The products purchased by the User remain the property of Stellantis Europe S.p.A. until the order has been fully collected by Stellantis Europe S.p.A.. However, from the time of delivery to the address indicated by the User at the time of the order, the risks of the goods delivered are transferred to the customer.

Right of withdrawal

In accordance with Article L.121-16 et seq. of the Consumer Code, the Consumer User - i.e. non-professional - has a period of 14 (fourteen) working days from the date of delivery of his order, to return any item that does not suit him and request an exchange or refund without penalty, with the exception of the return costs.

The items must be returned in completely new condition, using the same mode of transport used by Stellantis Motorsport Racing Shop when the products were delivered, in their original packaging with the completed return form and a copy of the invoice to the following address:

LANCIA CORSE would like to inform its customers in particular that the right of withdrawal as provided for by law does not oblige it to take back items (derivative products and technical parts) that are no longer in their original condition (items assembled or worn, damaged, damaged, used, etc.).

Product Warranty:

The products for sale on the Lancia Corse website are not subject to a contractual warranty.

4. CONTENT OF THE SITE

Information on the site:

The information appearing on the Site is prepared by Stellantis Europe S.p.A. on the basis of the technical knowledge currently available and updated regularly. Stellantis Europe S.p.A. can in no way be held liable for direct or indirect damage that may result from material errors or lack of information or updates.

It is the responsibility of each User to ensure that the product purchased is suitable for the desired use and the use that is made of it.

Update:

Stellantis Europe S.p.A. reserves the right to modify and update, without prior notice, these General Terms and Conditions and any elements, products or services presented on the Site.

All of these changes are binding on the Users who must consult and accept these General Terms and Conditions each time they connect.

5. PROTECTION OF THE CONTENT OF THE SITE

Securing the site:

The User undertakes, in the use he makes of the Site, not to carry out any manipulation likely to cause computer or functional failures or of any kind affecting the operation of the Site or any server or service that may be accessible through the Site.

Stellantis Europe S.p.A. undertakes to implement all necessary means to ensure the security of the information that the User makes available to it via the Site. However, Stellantis Europe S.p.A. cannot guarantee the absence of interception of messages transmitted electronically.

Intellectual property:

Many elements of the Site are protected by intellectual property rights, the terms and conditions of which are specified in the Legal Notice.

Consequently, it is forbidden for any User to reproduce, copy, sell, resell and/or exploit all or part of the content of the site.

6. LIMITATION OF LIABILITY

Access and login:

The Site is accessible via the Internet.

It is recalled that the Internet is an open and informal network, consisting of the international interconnection of computer networks. The management of the Internet is not subject to any central entity and each portion of this network belongs to an independent public or private body. Its operation is therefore based on cooperation between the operators of the different networks without there being any obligation to supply or quality of supply between operators. Networks can have uneven transmission capacities and their own usage policies. No one can guarantee the proper functioning of the Internet as a whole. Consequently, Stellantis Europe S.p.A. assumes no responsibility or guarantee in the event of malfunction of the Internet (delay in transmissions or any other malfunction).

Performance of the contract:

Stellantis Europe S.p.A. cannot be held liable for the non-performance of the contract due to a case of force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire. With regard to products purchased to meet professional needs, Stellantis Europe S.p.A. shall not incur any liability for any indirect damage resulting from these terms and conditions, operating loss, loss of profit, damages or costs, which may occur.

The choice and purchase of a product or service is the sole responsibility of the User. The total or partial impossibility of using the products, in particular due to the incompatibility of the equipment, cannot give rise to any compensation, reimbursement or liability on the part of Stellantis Europe S.p.A., except in the case of a proven latent defect, non-conformity, defect or exercise of the right of withdrawal.

Misuse of the content of the site:

Stellantis Europe S.p.A. assumes no liability of any kind whatsoever in the event that a User has fraudulently used the Site.
